Mr. Rana Randhir Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 04-12-2020 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State, through Video Conferencing.
This application, for grant of anticipatory bail, arises out of Beur Police Station Case No. 396 of 2019, disclosing offences under Sections 341/323/307/354-A/504/506/34 of the Indian Penal Code.
The prosecution case, as per the First Information Report, is that the petitioner no. 1 assaulted one Damini Devi,

No.23001 of 2020(3) dt.04-12-2020 2/3 relative of the informant, by the butt of the pistol, petitioner no. 2 assaulted the informant by fists and slaps, petitioner no. 3 assaulted the informant on his head by lathi, petitioner no. 4 assaulted the father of the informant by means of lathi and petitioner no. 5 assaulted the informant and Damini Devi by means of farsa.
Learned Counsel for the petitioners submits that the petitioners have not committed any offence in the manner alleged and both the parties are agnates and co-villagers and there is case and counter case inasmuch as from the side of the petitioners, Praveen Ravidas has lodged Beur Police Station Case No. 395 of 2019 (Annexure-2) against the informant and others. He further submits that in the case lodged by the side of the petitioners, the informant of the present case has been granted anticipatory bail by this Court, vide order, passed in Criminal Misc. No. 679 of 2020 (Annexure-3).
On the other hand, learned Additional Public Prosecutor, referring to the case diary, submits that no injury report has been brought on record by the Investigating Officer and the allegation against the petitioners is that they assaulted the informant and his family members.
After having heard learned Counsel for the parties
Patna High Court CR. MISC. No.23001 of 2020(3) dt.04-12-2020 3/3 concerned and taking into consideration the fact that both the parties are agnates and co-villagers and there is case and counter case between them, I am inclined to grant the petitioners privilege of anticipatory bail.
This application is, accordingly, allowed.
Let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge III -cumAdditional Chief Judicial Magistrate, Patna, in connection with Beur Police Station Case No. 396 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
It is made clear that at the time of furnishing bail bonds, all the parties shall follow the guidelines regarding social distancing.
