1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 384, 386 and 387/ 34 of the Indian Penal Code.

3. The learned counsel for the petitioner submits that the petitioner has antecedent of two cases and the informant alleges that he received information that one accused was forcefully collecting extortion from vehicles near Vaishali crossing near Naugachia. Accordingly, the force reached the place of occurrence and one accused namely, Prince was apprehended, who disclosed that he is collecting the money at the behest of the petitioner, who has taken contract of parking stand of Railway Naugachia and from possession of Prince,

4. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant based on confessional statement of Prince. It is next submitted that petitioner is a contractor and has taken contract of the parking stand of the Railways at Naugachia Railway Station. It is further submitted that petitioner has no concern with Prince and it appears that someone inimical to the petitioner planted Prince in order to defame the petitioner. It is also submitted that petitioner was not found at the place of occurrence. It is also submitted that the contract of the petitioner is for three years i.e. from 14.02.2023 to 13.02.2026, as such, petitioner would not indulge in any act which would bring disrepute and at the same time would threaten his contract also.

5. The learned A.P.P. Sri Chandra Bhushan Prasad opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on anticipatory bail on his furnishing bail-bonds in the sum of Rs.

No.27189 of 2025(2) dt.06-05-2025 3/3 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Bhagalpur in connection with Naugachia P. S. Case No.416 of 2023, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

7. The application stands allowed.
