Meena Singh, learned counsel for the petitioner, Sri Nityanand, learned Addl. Public Prosecutor as well as Sri Binod Gautam, learned counsel, who was assisted by Sri Ashok Kumar, learned counsel for the informant/Opp.Party no.2.
The sole petitioner, husband of the informant/Opp.Party no.2, has approached this Court for grant of anticipatory bail in Mahila P.S. Case No.52/2016 registered for the offence under Sections 498(A), 323, 341/34 of the Indian Penal Code and Sections 3 /4 of the Dowry Prohibition Act. By way of referring to the statement made in
Patna High Court Cr.Misc. No.48786 of 2016 (2) dt.06-12-2016 2/2 paragraph-10 of the present petition, it has been argued that the petitioner is ready to keep the informant as wife with full honour and dignity.
Learned counsel for the informant submits that if the petitioner keeps her with respect and dignity as wife, there is no reason to oppose the prayer for grant of anticipatory bail. Accordingly, in the event of arrest or surrender within six weeks from today, let the petitioner, namely, Ranjit Shahi be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Bikramganj, District-Rohtas in connection with Mahila P.S. Case No.52/2016.
It is made clear that after being released, the petitioner will keep the informant as wife with full respect and dignity. If at subsequent stage, the petitioner starts any torturing to the informant, the informant would be at liberty to approach this Court by filing a mentioning slip, so that this Court may recall its order.
