The petitioners are apprehending their arrest in connection with Madanpur P.S. Case No. 78 of 2017 registered under Sections 341, 323, 307 and 379/34 of the Indian Penal Code.
Allegation against the petitioners is of assaulting the son of the informant with lathi and danda.
Submission of learned counsel for the petitioners is that there is general and vague allegation against the petitioners and there is no injury report available on record. Heard learned APP also. He opposed the prayer for anticipatory bail stating that there is allegation of assault against
Patna High Court Cr.Misc. No.37185 of 2017 (2) dt.19-08-2017 2/2 the petitioners and without examining the injury report it cannot be ascertained as to whether the injuries are simple or grievous. Having heard both sides and in view of facts and circumstances, I am not inclined to grant anticipatory bail to the petitioners. Let petitioners surrender before the court below and pray for regular bail and the court below will pass appropriate order on the basis of injury report, without being prejudiced by this order, if possible, on the same day.
With the above observation, this application is disposed of.
