The petitioner has prayed for bail in a case registered for the offence punishable under sections 420, 467, 468, 471, 054, 506/34 of the Indian Penal Code.
As per allegation in the FIR, petitioner has created false documents and got mutated the informant's land in the name of his ancestor, namely, late Brahmdeo Singh with a view to grab his land.
It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. This case relates to civil in nature for which a criminal case in instituted against him. Informant of this case filed Dhakil Kharil Appeal Case No. 27 of 2021-22 challenging the order passed in Dakhil
Patna High Court CR. MISC. No.26570 of 2023(2) dt.23-05-2023 2/2 Kharij Case No. 221 R 27/2020-21 before the court of DCLR, Sonpur, Saran at Chhapra which was decided on dt. 25.2.2022 wherein the learned Court of DCLR refused to entertain the appeal and thus, rejected the same. Petitioner is languishing in judicial custody since 17.3.2023.
The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJMII, Saran at Chhapra/Successor Judge in connection with Dighwara P.S. Case No. 349 of 2022.
