====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 11-11-2020 Heard counsel for the petitioners and counsel appearing on behalf of the State.
The petitioners are apprehending arrest in connection with Pirpaity P.S. Case No. 268 of 2019 for offences under Sections 341, 323, 448, 307, 326, 504, 506/34 IPC and 3⁄4 Dian Act.
The allegation against the petitioners is in the name of practicing dian act by the petitioners on account of burn injury to the informant.
Learned counsel for the petitioner submits that the petitioners have no criminal antecedent. The petitioners and the informant are Gotias and there is land dispute between the
Patna High Court CR. MISC. No.26825 of 2020(2) dt.11-11-2020 2/2 parties.
Considering the fact that the petitioners are ladies and they are Gotias of the informant, and the petitioners have no criminal antecedent, the Court is inclined to grant bail to the petitioners. Let the petitioners, above named, in the event of arrest or surrender within four weeks from the date of communication of the order, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the ACJM- 11th , Bhagalpur in connection with Pirpaity P.S. Case No. 268 of 2019, subject to the conditions as laid down under Section 438(2) Cr. P. C.
