The petitioner is in custody since 03.07.2018 in connection with Sidhwaliya P.S. Case No. 140 of 2018 for the offence registered under Sections 399, 402, 414, 120(B) of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner was taken into custody on mere suspicion and the allegation was levelled that he was planning along with one other person to commit crime and only to implicate him deeply, the allegation regarding possession of illegal arms has been saddled on his shoulders. It is further submitted that the petitioner is not having any criminal antecedent and co-accused

Patna High Court CR. MISC. No.24961 of 2019(2) dt.19-04-2019 2/2 namely, Prabhat Manjhi has since been granted bail vide order dated 14.02.2019 passed in Cr. Misc. No. 8708 of 2019. Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge, Gopalganj in connection with Sidhwaliya P.S. Case No. 140 of 2018.
