ANJANA MISHRA ORAL ORDER 16-02-2016 Learned counsel for the petitioner seeks permission to withdraw the anticipatory bail application of petitioner no. 3, namely, Prafull Kumar Singh @ Golden Kumar.

Permission is granted.

Accordingly, the application as against petitioner no. 3, namely, Prafull Kumar Singh @ Golden Kumar is dismissed as withdrawn.

Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners apprehend their arrest in connection with Dehri (Indrapuri) P.S. Case No. 281 of 2015 registered for the offences punishable under Sections 341, 323, 324, 307, 504/34

Patna High Court Cr.Misc. No.51950 of 2015 (3) dt.16-02-2016 of the Indian Penal Code.

Learned counsel for the petitioners submits that there is case and counter case between the parties and both parties having sustained injuries. It is further submitted that in the case diary, it has come that the said Abhay Kumar has also sustained injuries which are simple in nature.

Considering the nature of allegation and also the fact that the petitioners have no criminal antecedents, let the petitioner nos. 1 and 2 namely, Hirdaya Nand Singh and Kusum Devi, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Rohtas at Sasaram in connection with Dehri (Indrapuri) P.S. Case No. 281 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
