The petitioner is apprehending arrest in a case registered for the offences punishable under sections 272, 273 of the Indian Penal Code and 47a of the Excise Act. It is alleged that from the wooden shop of the petitioner country made and foreign liquors were recovered. It is submitted by learned counsel for the petitioner that there is nothing on record to suggest that Gumti shop is being run by the petitioner and the petitioner has never been made accused in any case under the Excise Act. The aforesaid facts constitute ground for consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner, if the
