2. The petitioner seeks bail in connection with Goradih PS Case No.201 of 2024 dated 21.12.2024, instituted for the offence punishable under Sections 126(2), 115(2), 118(1), 109, 352, 3(5) of the Bhartiya Nyaya Sanhita, 2023.
3. The allegation against the petitioner is that he assaulted the son of the informant on his head by means of axe due to which he sustained injury.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. There is case and counter case between the parties. It is further submitted that there is specific allegation that he assaulted the son of the informant on his head by a sharp edge
Patna High Court CR. MISC. No.25182 of 2025(2) dt.30-04-2025 2/2 weapon, but the injury report does not corroborate the allegation against the petitioner. The injury report reveals that nature of the injury was grievous caused by hard and blunt substance. Charge-sheet has been submitted in the case. Lastly, it is submitted that the petitioner is in custody since 23.12.2024 having clean antecedents.
5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Bhagalpur, in Goradih PS Case No.201 of 2024.
7. The application stands allowed.
