NATH ORAL ORDER 16-04-2015 Nobody appears on behalf of the petitioners even after repeated calls for hearing. Learned Counsel for the State respondents is present.
Perused the records. From the order sheet it transpires that earlier also nobody appeared on behalf of the petitioners and this writ application had stood dismissed for default as against respondent nos. 4(i) to 4(iv) for want of compliance of the order of this Court. The said dismissal was recorded in the year 2000 and since thereafter till today no step has been taken on behalf of the petitioners for restoration of this application as against respondent nos. 4(i) to 4(iv).
Patna High Court CWJC No.3127 of 1997 (11) dt.16-04-2015 From perusal of the records it further transpires that respondent nos. 4(i) to 4(iv) were necessary parties to this writ application. Disposal of this writ application in absence of respondent nos. 4(i) to 4(iv) may result in inconsistent orders. As such, the writ application is dismissed as incompetent. (V. Nath, J.) Snkumar/- U
