The petitioners apprehend their arrest in Bidupur P.S. Case No.342 of 2018 registered under Section 379 of the Indian Penal Code and under Sections 4/40 (8) and (10) of Bihar Minor

Patna High Court CR. MISC. No.24174 of 2019(2) dt.15-04-2019 2/2 Mineral Concession Rules.

The petitioners are made accused on the allegation that the petitioners had stored the sand by way of illegal mining and transportation.

Learned counsel for the petitioners submits that nobody has seen the petitioners mining the river bed and storing the sand by the side of the river.

Having considered the facts aforesaid and the nature of allegation against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. XIV, Vaishali at Hajipur in connection with Bidupur P.S. Case No.342 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
