Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner seeks bail in Barahiya P.S. Case No. 108 of 2017 (NDPS Case No. 01 of 2017, registered for the offence punishable under Section 8/20(b)(II)(c) of the NDPS Act.

Earlier bail application of this petitioner has been rejected twice by this Court. This is third attempt. Vide order dated 05.11.2020, report regarding current stage of trial was called for and the same has been received which is kept at flag 'R'. From the report, it appears that out of five chargesheeted

Patna High Court CR. MISC. No.26762 of 2020(4) dt.21-12-2020 2/2 witnesses and two witnesses of seizure list, six witnesses have been examined and rest one official witness is to be examined. In view of the aforesaid report, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.
