ANJANA MISHRA ORAL ORDER 20-07-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending her arrest in connection with Alam Nagar P.S. Case No.143 of 2015 for allegedly having committed the offence under Sections 341, 323, 504, 506, 420, 467, 468 and 471 of the Indian Penal Code.
Learned counsel for the petitioner submits that in pursuance of the Government decision and in the light of the order passed in CWJC No.15459 of 2014 that no steps or proceedings will be taken against those who had obtained appointment illegally if they resign on or before 09.07.2015, the petitioner resigned on 09.07.2015 itself and yet the
Patna High Court Cr.Misc. No.29982 of 2017 (3) dt.20-07-2017 2/2 prosecution has been launched against her.
Considering the fact that now the petitioner has already resigned from service prior to the filing of the First Information Report, let the petitioner, above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Udakishunganj, Madhepura, in connection with Alam Nagar P.S. Case No.143 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
