JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 24-10-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Kotwali (Adampur) P.S. Case No. 279 of 2014, registered under Sections 420, 467, 468, 471 & 419/34 of the Indian Penal Code. The accusation is that the informant along with Indrajeet Kumar and Kishore Mandal had gone to Registry Office, Bhagalpur for executing the sale deed regarding 1440 Sq.ft land of Thana No. 103, but both of them got prepared sale deed in respect to 01 Acre 05 decimals of land of Thana No. 127, which was being drafted by this petitioner.

Learned counsel for the petitioner submits that petitioner is only deed writer and at the instruction of the parties, he drafted the draft of sale deed according to their instructions, as such petitioner had

Further submission is that co-accused Indrajeet Kumar, who is said to be the one of the purchasers has already been granted Anticipatory Bail by a co-ordinate Bench of this Court on 04.05.2016 passed in Criminal Miscellaneous No. 17780 of 2016.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Adampur) P.S. Case No.279 of 2014, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
