Petitioners apprehend arrest in a case registered for the offences punishable under sections 341, 323, 366-A and 504 of the Indian Penal Code and section 3(i)(x) of the S.C./S.T. (Prevention of Atrocities) Act.
The informant alleged that Rajesh Kumar kidnapped his minor daughter and took her to Bengal. Rajesh Kumar kept his daughter in the house of his parents. The informant went there and tried to bring his daughter but the petitioners are alleged to have abused the informant by naming his caste.
Patna High Court Cr.Misc. No.51854 of 2015 (2) dt.22-12-2015 It is submitted that the entire allegation is false and concocted. Petitioners are father and mother of Rajesh Kumar and they have no knowledge about the victim and their son. There is no allegation that the petitioners took part in kidnapping of the victim girl.
Considering the facts aforesaid, petitioners above named, in the event of arrest or surrender in the court below within four weeks from the date of receipt/production of a copy of this order, shall be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Buxar S.C./S.T. P.S. Case No. 28 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure, 1973. (Prabhat Kumar Jha, J) Amin/- U
