Despite repeated calls, none appears on behalf of the State.

The petitioner seeks pre-arrest bail in connection with Matiariya P. S. Case No. 50 of 2015 registered under Section 7 of the Essential Commodities Act.

It is contended that two quintals of rice was seized from the jeep which was kept in four plastic sacks of 50 Kg each. Neither the driver nor the owner of the vehicle was made accused and merely on the basis of unfounded suspicion the present case has been instituted by the Block Development Officer against the petitioner without verification of the stock register and distribution

Patna High Court Cr.Misc. No.52132 of 2015 (2) dt.10-11-2015 2/2 register kept in his P.D.S. shop.

Regard being had to the facts and circumstances of the case, in the event of arrest or surrender before the court below within six weeks from today, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Bettiah, West Champaran in Matiariya P. S. Case No. 50 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
