Petitioner seeks bail in Naugachhia P.S. Case No. 71 of 2019 registered under Sections 30(A) and 38(i) of the Bihar Prohibition and Excise Act.
The accusation is that when e-rickshaw which was being driven by the petitioner was searched then four packed boxes were recovered from which 59 bottles of all Seasons, Golden Collection Reserve whisky each containing 750 ml., 48 bottles of Royal Challenge Classic Premium whisky each containing 750 ml., 12 bottles of Royal Challenge Classic Premium whisky each containing 375 ml. were recovered. On quarry the petitioner did not produce any paper regarding carrying the same.

No.23257 of 2019(2) dt.11-04-2019 2/2 Learned counsel for the petitioner submits that, in fact, the boxes which were recovered from the e-rickshaw were loaded by the passenger to unload the same at a distance but in the meantime the petitioner was apprehended from the erickshaw and the petitioner was not aware about material of the packed boxes. He further submits that the petitioner having no criminal antecedent is in custody since1.3.2019. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount to the satisfaction of Additional Sessions Judge -2nd -cum-Special Judge, Bhagalpur, in Naugachhia P.S. Case No. 71 of 2019.
