The petitioner is languishing in custody for the offence punishable under Sections 413, 414 and 120(B)/34 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.

The report of the trial Judge would reveal that for non-appearance of some of the accused, the trial is still lingering.

Trial Court is directed to separate the trial of the petitioner and proceed with the trial according to law. In the past prayer for bail of the petitioner was refused on 25.04.2019 considering the fact that petitioner has got a long list of criminal cases against him and a pistol along with cartridges were recovered from his possession. Petitioner is in

Patna High Court CR. MISC. No.23374 of 2020(3) dt.01-02-2021 2/2 custody since 27.07.2018.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail for the present in connection with Gurua P.S. Case No. 136 of 2018.

Hence, prayer for bail is refused.

The petitioner would be at liberty to renew prayer for bail after framing of the charges.
