The Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 392/411 of the Indian Penal Code.

Four persons robbed the informant while he was returning after attaining the doctor along with his family members including sister and brother. Out of four, two were apprehended by the police soon after the occurrence and snatched notes were recovered from them and they disclosed the name of the petitioner as co-culprit.

Submission of the petitioner is that the petitioner has got no criminal antecedent and only material against the petitioner is

Patna High Court Cr.Misc. No.40273 of 2016 (3) dt.02-02-2017 2/2 confessional statement of the co-accused. Other witnesses, who were accompanying the informant, have also supported the F.I.R. that four persons were there who had robbed.

Considering the nature of offence and allegation, I am not inclined to grant anticipatory bail to the petitioner in connection with Kadamkuan Police Station Case No. 26 of 2016 pending in the court of Mr. Madhvendra Singh, learned Judicial Magistrate, 1st Class, Patna/Successor Court. However, prayer for regular bail shall be considered by the Court-below without being prejudiced by the order of this Court. Accordingly, the prayer for anticipatory bail is rejected.
