2. The petitioners seek pre-arrest bail in connection with Parbatta P.S. Case No. 229 of 2023 registered for the offence(s) punishable under Sections 147, 148, 149, 341, 323, 379, 307 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the allegation made in the FIR, the petitioners along with other accused has assaulted the informant and his wife and petitioner no.2 has fired upon the informant due to which he sustained injury.

4. Considering the nature of allegation made against the petitioners and the evidence, which has come in course of investigation, I find that the allegation of firing upon the informant is not against the petitioner no.1 but it is against the petitioner no.2, I am of the opinion that petitioner no.1 has, prima facie, made out a case to be released on pre-arrest bail.

5. The petitioner no.1, above named, is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - III, Naugachhia in connection with Parbatta P.S. Case No. 229 of 2023, subject to the conditions as laid down under Section 482 of the BNSS.

6. So far as, the petitioner no.2 is concerned, in view of the material, which has come in course of investigation, I am not inclined to enlarge the petitioner no.2 on pre-arrest bail.

7. Accordingly, the present bail petition stands disposed of.
