The petitioner apprehends his arrest in connection with Nabinagar P.S. Case No. 148 of 2017 registered under Sections 379, 420, 34 of the Indian Penal Code and section 40 of the Bihar Mines Act.
Learned counsel appearing on behalf of the petitioner submits that petitioner is not named in the F.I.R. On perusal of Annexures 2, 2/A and 3, it appears that the petitioner, being the owner of the tractor, has valid documents and the said tractor was also insured. Annexure No. 3 also shows that the loaded sand was not stolen one.
Having considered the facts and circumstances of the
Patna High Court Cr.Misc. No.33506 of 2017 (2) dt.20-07-2017 2/2 case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Aurangabad in connection with Nabinagar P.S. Case No. 148 of 2017, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Arvind Srivastava, J) Shailendra/- U T
