The petitioner apprehends his arrest in a case under Sections 376, 511, 323 of the Indian Penal Code. The informant alleged that while she had gone to attend the call of nature, the petitioner put her down on the ground, torn her clothes and made an attempt to commit rape with her. On raising of alarm, the villagers came and saved the informant. It is submitted that on account of land dispute, the petitioner has falsely been implicated in the case. The informant filed a petition to compromise the case.

Considering the nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail in Forbesganj P.S. Case No. 466 of 2015. Accordingly, the same is rejected.

Patna High Court Cr.Misc. No.51954 of 2015 (2) dt.04-01-2016 2/2 The petitioner, if so advised, may surrender in the court below and make prayer for regular bail. The court below shall consider the prayer for regular bail of the petitioner without being prejudiced from this order.
