The petitioners apprehend their arrest in connection with Muffasil P.S. Case No. 97 of 2016 registered under Sections 341, 323, 308, 379, 354, 34 and 504 of the Indian Penal Code. The accusation of informant Kushum Devi is that in the evening at about 6:00 pm. children were playing at her door, in the meantime, they started to scuffle. When she tried to rescue, petitioners and one Rituraj Yadav came armed with lathi and iron rod and petitioner Krishna Yadav gave rod blow on her head and Rituraj Yadav caught hold her hand and Braj Mohan Yadav caused injury at her leg. Patna High Court Cr.Misc. No.38880 of 2016 (2) dt.04-10-2016 2/2 came. Thereafter, the accused persons fled away. Learned counsel appearing on behalf of the petitioners submits that in course of scuffle of children, the occurrence took place, in which petitioner no. 1 Krishna Yadav also sustained injury, regarding which Aurangabad Muffasil P.S. Case No.98 of 2016 was instituted for the offence under sections 341, 323, 308 and 504 of the I.P.C. Moreover, the injuries, as found on the person of the informant, are simple in nature. Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the C.J.M., Aurangabad in connection with Muffasil P.S. Case No. 97 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J) Shail/- U T
