Petitioner apprehends his arrest in connection with Barbhigha P.S. Case No. 105 of 2018 registered for the offence punishable under Section 379 of the Indian Penal Code, Section 40 of Bihar Minor Mineral Act, Section 6 and 8 of Bihar Illegal Mines and Transportation Act and Section 15 of Environment Protection Act.

Petitioner along with two other accused persons are said to have been running brick-kiln without depositing the revenue and obtaining no objection certificate from the concerned department.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.27029 of 2019(2) dt.30-04-2019 2/2 that the petitioner is quite innocent. He has committed no offence. He has been falsely implicated in this case. Petitioner does not happen to be owner of the brick-kiln rather is staff. The owner of the brick-kiln is Tuntun Singh, but in the owner column, name of the petitioner and another staff, namely, Anjani Kumar have been mentioned, showing them as owner of the brick-kiln. Petitioner has no criminal antecedent. On the other hand, learned APP opposed the bail prayer of the petitioner.

In the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sheikhpura in connection with Barbhigha P.S. Case No. 105 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
