The petitioner apprehends his arrest in a case under Sections 302, 201/34 of the Indian Penal Code and Section 27 of the Arms Act.

The informant, husband of the deceased, made a specific allegation that while his wife was watching Jaimala ceremony of the marriage of the daughter of Mahendra Yadav, the petitioner fired which hit his wife. The informant went there and enquired about his wife but the accused persons disclosed that she was taken to the hospital for treatment. It is submitted that the informant himself filed a petition (Annexure-2) that the wife of the informant was cremated and he lost his mental condition. It appears from the perusal of the records that a case under Section 144 Cr.P.C. was going on between the parties and the petitioner was on inimical term with the informant. It appears

Patna High Court Cr.Misc. No.51810 of 2015 (2) dt.21-12-2015 2/2 from perusal of Annexure-2 that it is a broot attempt to tamper with the evidence immediately after institution of the case. Having considered the facts aforesaid and the nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail in Tekari P.S. Case No. 183 of 2015.
