ANJANA MISHRA ORAL ORDER 20-07-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 147/148 /149/341/323/354/379/427/504/506 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioners submits that admittedly there is a land dispute between the parties and that the occurrence took place on account of illegal construction being made on the land which is purportedly belonging to the petitioners. It is submitted that though there was altercation at the alleged occurrence, the attack is said to have been made by hands, fists and lathi which was neither pre-meditated nor intended to cause any bodily harm.

In view of the aforementioned facts and circumstances and that the petitioners are having a clean antecedent, let the petitioners above named, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Udakishunganj, Madhepura, in connection with Chuosa P.S. Case No. 65/2017, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
