The petitioner seeks bail in connection with Warisnagar P.S. Case No. 24 of 2019 (G.R. No. 198/2019) registered under Sections 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The accusation is that on receiving secret information about unloading of illicit liquor from two vehicles at Satmalpur, informant along with police officials reached there and saw that some persons were unloading liquor from Scorpio and Mahindra KUV100. After seeing the police party, some of the accused persons tried to flee away but two persons

Patna High Court CR. MISC. No.23613 of 2019(2) dt.12-04-2019 2/2 were apprehended who disclosed their name as Md. Fajail (driver) and Ranjit Kumar (petitioner). On search, 86 litres foreign liquor was recovered from Scorpio and 90 liters foreign liquor was recovered from Mahindra KUV100.

The learned counsel appearing on behalf of the petitioner submits that petitioner was made accused in similar nature of cases and due to that reason he has been made accused in the present case by the police. Petitioner is in custody since 11.02.2019.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 3rd Addl. Sessions Judge-cum-Special Judge Excise, Samastipur in connection with Warisnagar P.S. Case No. 24 of 2019 (G.R. No. 198 of 2019).
