JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-09-2022 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under section 395 of the Indian Penal Code.

Prosecution case is that three unknown miscreants assaulted the informant and took away cash Rs.90,000/- and mobile phone.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case merely on the basis of suspicion. It is stated in paragraph 3 of the bail petition that the petitioner has got clean antecedent. Learned counsel for the State opposes the prayer for bail submitting that the petitioner has been identified by the informant in the CCTV camera footage.

Considering the fact that petitioner has been identified

Patna High Court CR. MISC. No.25872 of 2022(2) dt.20-09-2022 2/2 by the informant in the CCTV camera footage, his prayer for bail is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
