====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 14-10-2020 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.
Petitioner is apprehending arrest in connection with Katihar Town P.S. Case No. 01 of 2020 for the offence under sections 406, 420 of the Indian Penal Code and 138 of N.I. Act. Learned counsel for the petitioner submits that petitioner has no criminal antecedent. He further submits that allegation against this petitioner is that he issued a cheque for repayment of loan but the same was dishonoured. Learned counsel submits that in the present case the parties have entered into a compromise on 29.8.2020. In view of the aforesaid, the application is disposed of with a direction to the court below to examine whether the parties have entered into the compromise as stated by the
Patna High Court CR. MISC. No.23469 of 2020(2) dt.14-10-2020 2/2 counsel for the petitioner on 29.8.2020 and if it is found to be correct, the court below shall release the petitioner named above in the light of the compromise in the event of arrest or surrender before the court below within a period of four weeks from the date of communication of this order, on anticipatory bail on furnishing bail bond of Rs. 50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Katihar, in connection with Katihar Town P.S. Case No. 01 of 2020 subject to the condition as laid down under section 438(2) of the Cr.P.C.
