2. The petitioner have preferred this application for grant of regular bail in connection with Harsidhi P.S. Case No. 454 of 2024 dated 23.08.2024 registered for the offences punishable under Sections 309(4) and 111 of B.N.S., 2023.

3. As per the prosecution case, on 22.08.2024 at about 2.00 P.M., three unknown miscreants ridding on a motorcycle came and entered the C.S.P. Bank in which the informant was doing official work and on the point of weapon, snatched his mobile phone and also assaulted him.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. No incriminating article has been recovered from the

Patna High Court CR. MISC. No.25867 of 2025(2) dt.07-07-2025 2/2 conscious possession of the petitioner. It is submitted that the petitioner is not named in the F.I.R. His name has surfaced in the present case in the confessional statement of the co-accused, Amanullah, who has already granted regular bail by this Court vide order dated 05.03.2025 passed in Cr. Misc. No. 11028 of 2025. No TIP has been conducted by the prosecution. The petitioner has three criminal antecedents in which he is on bail in all cases as stated in paragraph no. 3 of the bail petition. He is in custody in this case since 18.10.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Ist Class, Judicial Magistrate, East Champaran, Motihari in connection with Harsidhi P.S. Case No. 454 of 2024.

7. The application stands allowed.
