JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 22-04-2019 Heard learned counsel for the petitioners, the learned APP and the learned counsel for the informant. This application for anticipatory bail arises out of Raniganj P.S. Case No. 336 of 2018, disclosing offences under Sections 147,148,341,323,324,379,354B,307, 506 and 504 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioners
Patna High Court CR. MISC. No.26108 of 2019(2) dt.22-04-2019 2/3 has submitted that evidently since the marriage of informant's sister with Subodh Bahardar is being objected by the villagers, the occurrence had taken place.
Learned counsel appearing on behalf of the petitioners has submitted that there is allegation against Pintu Bahardar, an accused of having assaulted the father of the informant, which is said to be grievous. So far as these petitioners are concerned, there is no specific allegation of assault leading to grievous injury.
Considering the above submission, this application is allowed.
Let the petitioners above named in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in Raniganj P.S. Case No. 336 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their
