2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 76, 351(2) and 352 of B.N.S., Section 8 of POCSO Act and Sections 3(i)(r) (s)(w) and 3(2)(va) of S.C./S.T. Act.

3. The case of the prosecution, in short, is that the petitioner has appropriately touched the body of the minor daughter of the informant.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. Learned counsel for the petitioner has submitted that the

Patna High Court CR. MISC. No.29069 of 2026(2) dt.06-05-2026 2/2 occurrence is of 28.06.2025 at 2 P.M. whereas the F.I.R. was lodged on next day. It has further been submitted that there was some dispute between the parties regarding some transaction of cash. When the petitioner demanded the cash, this case has been filed in counterblast. It has further been submitted that petitioner is an old person aged about 66 years. He is having criminal antecedent of one case in which he is on bail and he is languishing in judicial custody since 01.12.2025.

5. Learned APP appearing for the State has vehemently opposed the application for bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-cum-Spl. Judge, POCSO, Banka in connection with Belhar P.S. Case No. 194 of 2025. (Ashok Kumar Pandey, J) lata/- U T
