For the Petitioner/s : Mr. Arvind Pandey For the Opposite Party/s : Mr. Sri Pranav Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 17-10-2016 Heard the Counsel for the petitioner and the APP for the State.

Apprehending his arrest in Khjekalan P.S. Case No. 59 of 2016 registered under sections 147, 148, 149, 341, 323, 307, 302 of the Indian Penal Code and Section 27 of the Arms Act, the petitioner has filed the present application for anticipatory bail. On account of previous animosity, it is alleged that coaccused Karu Paswan along with his son and others armed with fire arms came to the darwaja and started firing indiscriminately which caused injury to as many as six persons one of them being brother of the informant who died on account of the injury sustained.

Contention of the petitioner is that there is general and omnibus allegation against the petitioner. The main allegation is

Patna High Court Cr.Misc. No.37722 of 2016 (2) dt.17-10-2016 2/2 against Karu Paswan and his four sons.

Learned APP, on the other hand, while opposing the prayer, had contended with reference to the order of the learned Sessions Judge that in course of investigation, it has come that the petitioner was also amongst those who fired indiscriminately. Looking to the seriousness of the allegation and the other materials reflected from the record, I am not inclined to extend the privilege of anticipatory bail to the petitioner. Prayer is rejected.
