The petitioner is in judicial custody in connection with Sultanganj P.S. Case No. 94 of 2021 registered under Sections 341, 323 and 307/34 of the Indian Penal Code lodged Price 19 on 13.05.2021 by the informant, Roshan Yadav. The informant has alleged in the First Information Report that the accused persons including the petitioner herein demanded milk from informant's father and on his refusal, he was threatened of dire consequences. Subsequently, it is alleged that when he was going back home, the accused persons including the petitioner herein came riding their horses and after pushing his father crushed him with the leg of the horse causing head injury and ultimately the injuries were treated in Patna
Patna High Court CR. MISC. No.25784 of 2023(3) dt.21-06-2023 2/2 after being referred from the local hospital. Earlier prayer for bail of the petitioner was rejected vide order dated 10.05.2022 passed in Cr. Misc. No. 59271 of 2021. Now fresh petition has been filed.
As per the report dated 04.05.2023, eight out of nine witnesses have been examined and as such the trial is at an advanced stage.
Taking into account the aforesaid fact, this Court is not inclined to extend him the privilege of bail for the present which is accordingly dismissed.
However, the trial court is directed to expedite the trial conclude the same within a period of six months. (Rajiv Roy, J) Jagdish/kiran/- U T
