The petitioner seeks regular bail in connection with Nawada Town Police Station Case No. 940 of 2019, registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

The allegation against the petitioner is that the police raided the house of the petitioner and recovered a total quantity of 55 litres of illicit country-made (Mahua) liquor. Learned Counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and illicit liquor has not been recovered from the conscious possession of the petitioner. After having heard learned Counsel for the parties and taking into consideration the fact that the petitioner has got no criminal antecedent and he is in custody since 22.05.2020, I am inclined to grant regular bail to the petitioner. This application is allowed.

Accordingly, let the petitioner, above named, be released on bail, upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II -cumSpecial Judge, Excise, Nawada, in connection with Nawada Town Police Station Case No. 940 of 2019.

It is made clear that at the time of furnishing bail bonds, all the parties shall follow the guidelines regarding lockdown and social distancing.
