====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-02-2022 Heard learned counsel for the petitioner, the State and the informant.
The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 366A/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The victim in her statement recorded under section 164 Cr. P. C. has stated that she voluntarily gone with the petitioner and solemnized marriage with him and is living as husband and wife. She has stated her age to be 20 years and the Court below has also assessed her age to be 19 years. Petitioner has claimed clean antecedent and he is in custody since 1.2.2021. Learned counsel appearing for the State as well as the informant oppose the prayer for bail.
Considering the aforesaid facts and circumstances of the case and the aforesaid statement of the victim, prayer for bail of the petitioner is allowed. Let the petitioner, as named
