The petitioner is apprehending his arrest in connection with Mejorganj P.S. Case No. 159 of 2015 instituted for the offences punishable under Sections 420 and 409 of the Indian Panel Code.

As per prosecution case, the petitioner has misappropriated Government money which was entrusted to him for the construction work of the Primary School, Pachaharwa, Majorganj.

It has been submitted on behalf of the petitioner that the petitioner has been made accused due to mistake of fact and the allegation of misappropriation of public money has been denied by

Patna High Court Cr.Misc. No.51678 of 2015 (5) dt.10-02-2016 2/2 the petitioner. It has further been submitted on behalf of the petitioner that petitioner has got no criminal antecedent. It has further been submitted that the petitioner is ready to deposit an amount of Rs. 50,000/- in the court below which shall be subject to the final disposal of the case.

On behalf of the State, it has been submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that petitioner shall deposit an amount of Rs. 50,000/- in the court below which shall be subject to final disposal of the case. Let the above named petitioner, in the event of his arrest or surrender in the court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Majorganj P.S. Case No. 159 of 2015, on subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
