JUSTICE MOHIT KUMAR SHAH ORAL ORDER 11-07-2024 The present writ petition has been filed seeking the following relief:- "i) For issuance of writ in the nature of Mandamus or any other appropriate writ for commanding the respondents to remove the encroachment from the Gairmazarua Land, nature in Parti Kadim pertaining to Khata No.314, Plot No.1597 total area 63 decimal situated in Mauza-Village Ner, Thana No. 249, Tauji No. 3983 Anchal- Makhdumpur, District- Jehanabad."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Makhdumpur, District-Jehanabad for redressal of his aforesaid grievances.

Having regard to the facts and circumstances of the case, I deem it fit and proper to grant liberty to the petitioner to file appropriate petition, under the provisions of the Bihar Public Land Encroachment Act, 1956, before the Circle Officer, Makhdumpur, District-Jehanabad, which shall be considered by the Circle Officer, Makhdumpur, DistrictJehanabad, in accordance with law and appropriate action shall be taken, forthwith.

The writ petition stands disposed off on the aforesaid terms.
