JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 22-11-2016 Heard Mr. Anil Chandra in support of the application and Mr.Dayal, A.P.P. for the State.

The petitioner prays for Anticipatory bail in Barahara (Krishnagarh O.P) P.S. Case No. 216 of 2016, registered under Section 302 of Indian Penal Code and Section 27 of the Arms Act.

The F.I.R. was lodged against the unknown alleging that the dead body of the deceased was brought by two persons to his house. Those two persons in their statement alleged that when they reached the deceased, it was whispered that some unknown persons fired at him. In course of investigation, the name of the petitioner transpires as one, which provided the location. The petitioner is suspected to be the member of the gang of Bhim

Patna High Court Cr.Misc. No.45981 of 2016 (3) dt.22-11-2016 2/2 Singh. It is submitted that except suspicion, there is no reliable material against the petitioner.

On the other hand, learned A.P.P. submits that investigation is still going on.

Considering the above, I am not persuade to extend him the privilege of anticipatory bail. The prayer of petitioner for anticipatory bail is rejected.
