Heard the parties including Mr. Jharkhandi Upadhyay, APP who has filed the counter affidavit.

The petitioner apprehends his arrest in connection with Lakhisarai P.S. Case No. 718 of 2019 registered for the offences punishable under Sections 406/409/420/34 of the Indian Penal Code.

It is submitted by learned counsel for the petitioner that the petitioner is a patient of prostate cancer and he has not committed any offence.

Considering the fact that the petitioner is suffering

Patna High Court CR. MISC. No.36316 of 2021(8) dt.25-04-2022 2/2 from prostate cancer, the present anticipatory bail application is allowed.

Accordingly, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Lakhisarai, in connection with Lakhisarai P.S. Case No. 718 of 2019, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
