In this case, the petitioner is apprehending his arrest in connection with Hathauri P.S. Case No. 22 of 2019 registered for offences under sections 272, 273/34 of the Indian Penal Code and 30(a), 38(i), (ii) of the Bihar Prohibition and Excise Act, 2016.

As per prosecution story, while the police was in paroling duty, he received a secret information that huge quantity of foreign liquor was being unloaded from a pickup van. The police went there but, the persons, present there, fled away. On search of the vehicle, 396 liter of illicit foreign liquor were recovered.

Looking to the quantity of illicit liquor recovered, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

Accordingly, the prayer for anticipatory bail of the petitioner, above named, is rejected.

If the petitioner surrenders before the court below within a period of three weeks from today and prays for bail, the court below, without being prejudiced by this order, will take a decision in accordance with law.
