It appears that all admitted dues of the petitioner have been paid. However, the period of service of the petitioner from

Patna High Court CWJC No.9730 of 2011 dt.07-10-2015 2/2 01.01.1965 to 01.01.1976 has not been taken into account on the ground that there is no record available in the Department relating to the actual work performed by the petitioner.

Learned counsel for the petitioner submits that he is in a position to substantiate his claim that he had also worked during the said period.

In the aforesaid background, the Court cannot record a finding on fact.

Accordingly, the writ petition stands disposed off with liberty to the petitioner to approach the authorities concerned with all materials available with him and satisfy them with regard to having actually worked for the said period also. If the authorities concerned come to a finding that the claim of the petitioner is justified, his retiral benefits shall be re-calculated and whatever remains to be paid shall also be paid within a period of four months from the date of the petitioner approaching the authority along with a copy of this order.
