The petitioner apprehends his arrest in (Jainpur) Phulwari Sharif P.S. Case No. 606/2014, registered for the offences punishable under Section 498(A), 34 of the Indian Penal Code and 3, 4 of the Dowry Prohibition Act.
The wife of the petitioner made allegation that the petitioner subjected her to physical and mental torture. He took his wife to his house, but it is alleged that the petitioner dropped his wife at a lonely place on the pretext of taking her to her naihar.
On the other hand, the learned counsel for the informant as well as learned A.P.P. vehemently opposed the prayer for bail.
Patna High Court Cr.Misc. No.20314 of 2015 (3) dt.02-11-2015 2/2 It appears that there is very specific allegation against the petitioner that he subjected her to physical and mental torture and on intervention of the Court the petitioner took his wife to his house and on the pretext of taking her to father's home he dropped the informant on way and fled away.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
