JUSTICE SUDHIR SINGH ORAL ORDER 23-12-2016 Supplementary affidavit has been filed on behalf of the petitioner. The same be kept on the record.

Heard learned counsel for the petitioner and learned APP for the State.

The petitioner is apprehending his arrest in a case registered under Sections 341, 307, 504/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation is that the accused persons including the petitioner abused the informant and co-accused Pankaj Sharma shot at the chest of the informant, as a result of which he sustained injury.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of

Patna High Court Cr.Misc. No.54918 of 2016 (2) dt.23-12-2016 2/2 tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. General and omnibus allegation has been made against the petitioner. Specific allegation has been made against the co-accused Pankaj Sharma. The nature of injury is said to be simple as per the Annexure-1 to the supplementary affidavit.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Khagaria in connection with Pasraha P.S. case No.22 of 2014 corresponding to G.R. No.444 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) Narendra/- U T
