Petitioners apprehend their arrest in Warisnagar P.S. Case No.13 of 2019, registered under Sections 147, 148, 341, 323, 307, 427, 379 and 504 of the Indian Penal Code.

The informant named the petitioners and alleged that while he was returning to his house from his brick kiln, the petitioners and four other accused persons intercepted his motorcycle. They began to abuse him. Hare Krishun Mahto, petitioner no.1 is alleged to have assaulted the informant with iron rod on his head and Mukesh Mahto, petitioner no.2 is said to have snatched Rs.25,000/- from his pocket. Other accused person Jai Kishun Mahto assaulted him with lathi.

Learned counsel for the petitioners submits that Ram

Patna High Court CR. MISC. No.26416 of 2019(2) dt.23-04-2019 2/2 Dulari Devi lodged Warisnagar P.S. Case No.12 of 2019 against Ramashray Das Brahmchari and others. Ramashray Das Brahmchari is the father of the informant of the present case. Ramashray Das Brahmchari and others had come to the house of the petitioners and assaulted the inmates on account of land dispute. Five person from the side of the petitioners were injured. The informant got as many as four injuries but all four injuries are simple in nature. Taking into consideration the fact that there appears that the case and counter case have been lodged from both sides on account of previous enmity alleging that one side assaulted the other as also the fact that the informant received simple injury on account of assault made by petitioner no.

1 and others, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Samastipur in connection with Warisnagar P.S. Case No.13 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
