Petitioner seeks bail in connection Excise Case no. 11 C2 of 2012 registered for the offence punishable under section 47(a), (f) of Excise Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 15.03.2021 and is person with clean antecedent and charge sheet has been submitted. Allegation is of recovery of 70 liter country made liquor in two plastic jar and 1000 kg Mahua and Jawa kept in 50 pots under the earth which was destroyed by excise officials. Learned counsel for the petitioner submits that petitioner has no concern with the seized liquor, further he was not arrested at the place of

It was only when petitioner came to know that false case has been instituted in the year 2021, he came from Haryana and surrendered in the court below. Learned APP opposes the prayer for bail and submits that petitioner has been absconding since 2012. Considering the submissions of learned counsel for the petitioner and charge sheet has been submitted, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the ADJ II-cum- Special Judge (Excise), Lakhisarai in Excise Case no. 11 C2 of 2012.
