The petitioners apprehend their arrest in connection with Baisi P.S. Case No. 100 of 2016 registered under Section 273 of the Indian Penal Code and Section 47(a) of the Bihar Excise (Amendment) Act, 2016.
The accusation is that, in course of checking of vehicle, Tata Sumo bearing registration no. BR11V-7897 was stopped, from which, while three persons were apprehended by the police but one succeeded to flee away. On search of the vehicle, 78 litres of Indian made foreign liquor recovered and apprehended accused persons also disclosed the name of the petitioner.

No.39008 of 2016 (2) dt.06-10-2016 Learned counsel for the petitioner submits that the petitioner has not been apprehended by the police at the spot rather his name has been disclosed by the apprehended co-accused. It is further submitted that petitioner has no criminal antecedent. Considering the aforesaid submissions, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.- 2, Purnea, in connection with Baisi P.S. Case No. 100 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
