ANJANA MISHRA ORAL ORDER 30-10-2015 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

The petitioners being father-in-law and mother-in-law of the deceased lady are apprehending their arrest in connection with Pali P.S.Case No.51 of 2014 registered under section 304B read with section 34 of the Indian Penal Code.

Case diary in the present case was called for which has been received.

Learned counsel for the petitioners submits that there is no specific allegation against these petitioners nor any overt act has been attributed to them. He further submits that the deceased was having strained relationship with her husband, who was a

Patna High Court Cr.Misc. No.32001 of 2015 (3) dt.30-10-2015 2/2 drunkard which was being resisted by the deceased. It is further submitted that husband of the deceased has already been taken into custody.

Considering the aforementioned facts and circumstances of the case and there being no further cogent reason in the case diary against these petitioners, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Pali P.S. Case No.51 of 2014 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
