The petitioners apprehend their arrest in connection with Complaint Case No. 3968 of 2013 registered for the offences punishable under Section 498(A) of the Indian Penal Code and Section 4 of Dowry Prohibition Act.
In pursuance of the order dated 01.10.2015, the petitioner and the opposite party no. 2 are present today. After interacting with both of them, it appears that leaving all the matrimonial dispute whatsoever, the petitioner and the opposite party no. 2 are willing and ready to lead their conjugal life.
Patna High Court Cr.Misc. No.19169 of 2015 (5) dt.30-10-2015 In view of the positive attitude taken by the petitioner as well as the opposite party no. 2, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Saran at Chapra in connection with Complaint Case No. 3968 of 2013, of subject to the conditions as laid down under Section 438(2) of the Cr.P.C. However, it is made clear that the opposite party no. 2 will go and cooperate with her husband in her matrimonial home and the petitioner will also take proper care to ensure congenial atmosphere in her matrimonial home so as to opposite party no. 2 may not be prejudiced in any manner. It is also expected that there shall be no recurrence of untoward incident.
With the aforesaid direction, the anticipatory bail application stands disposed of.
